These Terms of Use form a legal agreement (the “Agreement”) between you (the “User”) and Zain Basharat Ali (the “Provider”, “I”, or “me”) governing your use of the website zainali.dev (the “Website”) and the services offered through it. By accessing or using the Website, you confirm that you accept these Terms.

• Website — the website available at zainali.dev, including all of its pages and content.
• Device — the computer, mobile phone, tablet, or other gadget used to access the Website.
• Services — the portfolio, information, and freelance Flutter and mobile app development services presented and offered through the Website.
• Project Engagement — a separately agreed arrangement under which the Provider delivers development services to the User.
• Fees — the costs associated with a Project Engagement, agreed individually.

2. Services

The Provider grants you a personal, non-exclusive, non-transferable license to access and use the Website. The Services include browsing the Provider’s portfolio, learning about the Provider’s work, and contacting the Provider to request development services. The Provider may impose technical restrictions and may modify the functionality of the Website at any time.

3. Authorization

The Provider authorizes your access to and use of the Website. When you contact the Provider, you agree to provide accurate and complete information. The Provider processes any personal data you submit in accordance with the Privacy Policy. You are responsible for the accuracy of the information you provide.

4. Content

You retain all rights to the User Content you submit. By submitting User Content, you grant the Provider a license to use, store, and process such content to the extent necessary to respond to your enquiry and deliver the Services. You are solely responsible for the legality of the content you submit, and the Provider disclaims liability for any loss of such content.

5. User Restrictions

You must use the Website within legal and contractual limits. You agree to refrain from copying, revealing, reverse-engineering, scraping, or creating unauthorized derivatives of the Website or its content. Prohibited uses include any illegal, infringing, or harmful activity.

6. Provider’s and User’s Obligations

The Provider will deliver the Website and any agreed Services with reasonable skill and care. The User agrees to comply with applicable laws, these Terms, and — where a Project Engagement exists — to pay any agreed Fees and provide the information reasonably required to deliver the Services.

7. Term and Termination

This Agreement commences on the Effective Date. Either the User or the Provider may terminate it at their discretion and for any reason. Your access to the Website ceases upon termination.

8. Fees; Payment Terms

Access to and use of the Website is free of charge. Development services provided under a Project Engagement are subject to a separate quotation and agreement; the Fees and payment terms for any such engagement are agreed individually between the User and the Provider before work begins.

9. Liability

The Website is provided “as is” and “as available”, and the Provider disclaims all warranties to the maximum extent permitted by law. The Provider is not responsible for User Content or for any interruption to the availability of the Website. You agree to indemnify the Provider against claims arising from your use of the Website, and the Provider’s liability is limited to the extent permitted by applicable law.

10. Governing Law and Jurisdiction

These Terms of Use are governed by and construed in accordance with the laws of the Islamic Republic of Pakistan, and any disputes shall be subject to the jurisdiction of its courts.

11. Final Provisions

The relationship between the User and the Provider is that of independent parties. The processing of personal information is governed by the Privacy Policy. The Provider reserves the right to interrupt the Website for maintenance. These Terms represent the complete agreement between the User and the Provider regarding the use of the Website.
